PLEASE READ BEFORE COMMISSIONING!
Hello, and thank you for considering to do business with me! Below is my Terms of Service, which you must read and agree to before we can discuss a commission. This is to protect both our rights, and to prevent possible problems during the commission process.
General Information:
- By commissioning the artist, the client is agreeing to the Terms and Conditions outlined below.
- The client agrees that they are legally allowed to use all characters in the commission.
- The artist reserves the right to refuse any commission for any reason.
- The client must be able to communicate clearly with the artist in English.
- The client must provide the artist with a clear and understandable reference, either visual or written, of any characters being drawn. Reference must be up to date and accurate, or the client must be clear about any variation from the reference before work on the commission begins.
- Displayed prices are subject to change due to complexity, size, and materials of each individual piece of artwork.
Limitations:
- Due to the lack of materials and work space, commissions are currently only offered digitally. Traditional media commissions may be available in the future.
- The artist will not draw images that are sexually explicit, offensive or vulgar, contain illegal activities, or violate copyright or trademark law.
- Inquiries can be made to the artist if it is unclear whether a potential commission violates these limitations.
Payments, Cancellations and Refunds:
- A payment must be made in order to hold a commission slot.
- Unless otherwise agreed upon, all commissions must be paid in full before work begins.
- Prices are set in $USD.
- Payments sent through Paypal must be sent by either the Goods or Services option, depending on the nature of the commission. Never send payments via the Gift option.
- Work will not begin on a commission until a payment is received.
- The client will not receive the original artwork or un-watermarked digital image until full payment is received.
- The artist reserves the right to cancel a commission at any time due to rude or inappropriate behavior, poor communication, or violations to the Terms of Service from the client.
- If cancellation occurs, by either the artist or client, after progress has been made on the commission, the client will receive a refund minus the work that has been done. If cancellation occurs prior to the start of the commission, a full refund will be given.
Works in Progress and Edits:
- Upon request, the artist will provide a work in progress image during any stage of the art process (the sketching stage, the coloring stage, etc.) and then of the finished piece for approval.
- No major edits (such as a change of pose) will be made after a work in progress stage is approved by the client. The only exception is any large errors where the artist is at fault.
- Critiques and edits may be rejected by the artist if they pertain to artistic skill or style preference.
Expected Time Frames:
- Wait time for a commission will vary depending on size and complexity of an image. Small commissions such as icons will have a very short wait time, bigger commissions such as a full body image will understandably take longer.
- The artist will inform the client of any delays.
- If the client has a deadline for an image, they must inform the artist prior to payment. The artist will inform the client if they are able to meet that deadline.
- The client may request updates at any time.
Image Rights:
- Unless previously agreed upon (i.e. a commission for product usage, such as a logo), the artist retains all rights to the commissioned artwork, including the rights to create prints and/or merchandise.
- The artists retains the right to post the commissioned artwork publicly and use it for advertisement purposes. If the commission is time sensitive, such as a gift, the client may request that the artist delay public posting.
- Unless previously agreed upon (i.e. a commission for product usage, such as a logo), the client may not make prints of the artwork, or profit from the artwork in any way except in the reselling of a physical original piece of artwork (i.e. traditional media).
- The client may re-size or crop the artwork to create icons, wallpapers, etc., but they may not alter the artwork itself.
- The client is permitted to upload the commissioned artwork to their personal website or gallery only if credit is given and it must be the watermarked version of the artwork.
